EASTERBROOK, Circuit Judge. Psychiatrists Rafael Sanjuan and Marcello A. Maviglia passed written examinations and became eligible for certification by the American Board of Psychiatry and Neurology. Each took an oral examination administered by the Board; each failed. Oral examinations by panels of certified specialists are tape recorded. The Board will review a panel's Conclusions if the applicant pays an appeal fee that includes the costs of preparing a transcript. Instead of taking internal appeals, Sanjuan and Maviglia filed this suit, which the district court dismissed under Fed. R. Civ. P. 12(b)(6)., 1994-1 Trade Cas. P 70,618. They contend that the Board's examination practices violate the Sherman Act, the due process clause of the fourteenth amendment, and numerous principles of state law.
